First, we would like to inform you of your rights as a data subject. These rights are codified in Art. 15 - 22 GDPR. They are:

  • The right of access (Art. 15 GDPR),
  • The right to erasure (Art. 17 GDPR),

To assert these rights, please use data@yontex.com. The same applies if you have questions about data processing in our company or would like to revoke a granted consent. You also have the right to lodge a complaint to the data protection supervisory authority.

Right of objection

Please note the following with respect to the right of objection:

When we process your personal data for purposes of direct advertising, you have the right to object to such data processing at any time without indication of reasons. The same applies to profiling to the extent that it is related to direct advertising.

If you object to processing for purposes of direct advertising, we will no longer process your personal data for these purposes. You can notify you objection free of charge and without observing requirements of form via our contact form, preferably via data@yontex.com.

In the event that we process your data for the sake of legitimate interests, you can object to such processing at any time for reasons having to do with your particular situation; the same applies to any profiling on the basis of these provisions.

We will no longer process your personal data unless we can demonstrate compelling, legitimate reasons for the processing that prevail your interests, rights and freedoms, or when the processing serves the purpose of asserting, exercising or defending against legal claims.

Purposes and legal grounds of data processing

In processing your personal data, we comply with the provisions of the GDPR and all other applicable provisions of data protection law. The legal grounds for data processing are particularly set out in Art. 6 GDPR.

We use your data for business initiation, the fulfilment of contractual and statutory obligations, the performance of the contractual relationship, the offering of products and services and the strengthening of customer relationships, which can also include analyses for marketing and direct advertising purposes.

Your consent to data processing may also constitute a permission requirement under data protection law. Before granting consent, we will expressly inform you about the purpose of the data processing and about your right of revocation in the consent declaration.

Transfer to third parties

We will transfer your data only within the limits of the statutory provisions or if you have granted your consent. Otherwise, your personal data will not be transferred to third parties unless we are obligated to do so by virtue of binding statutory regulations (transfer to external entities such as supervisory authorities or criminal prosecution authorities).

Within our enterprise, we ensure that only those persons who need your personal data to fulfil our contractual and statutory obligations receive it.

In particuar cases, our departments are assisted in the performance of their duties by service providers and service partners. The necessary data protection agreements have been concluded with all service providers and service partners.

Transmission of data/ Intent to transmit data to third countries

The transmission of data to third countries (outside of the European Union or the European Economic Area) is only done when this is necessary to fulfil our obligations or is legally required or if you have granted us your consent to do this.

The foreign representations are obliged by corresponding contractual regulations to comply with the data protection standards and thus the data protection level of the EU."

 

Duration of data storage

We will store your data for as long as needed for the given processing purpose. Please note that numerous retention periods require that data continues to be stored. We are particularly required to do this by retention obligations under commercial law or tax law (e.g. German Commercial Code, Tax Code, etc.). Data is routinely erased as soon as no further retention obligations are in effect.

Furthermore, we may store your data if you have granted us your consent to do this or in the event of legal disputes, when we use the data as evidence for purposes of statutory limitation periods, which can last up to thirty years; the regular limitation period is three years.

Secure transmission of your data

We employ appropriate technical and organisational safeguards to protect the data stored with us at its best against accidental or intentional manipulations, loss, destruction or access by unauthorised persons. The level of security is continually reviewed and adapted to meet new security standards in collaboration with security experts.

Data transfers from and to our website are always encrypted. As the transmission protocol for our websites, we offer HTTPS and we always use the latest encryption protocols. It is also possible to use alternative communication channels (e.g. postal service).

Obligation to provide data

Some personal data is necessary for the establishment, performance and termination of the obligation and the fulfilment of the related contractual and statutory obligations. The same applies to the use of our website and the various functions it provides.

In certain cases, data must also be collected and/or provided due to statutory provisions. Please note that it is not possible to process your request or perform the underlying contractual obligations without having this data provided to us.

Categories, sources and origin of data

The data we process is determined by the context: This depends, for example, on whether you place an order online or submit an inquiry in our contact form or a complaint.

Please note that we may also separately provide information for special processing situations in an appropriate place, as when making a contact request, for example.

When you visit our website, we collect and process the following data:

  • name of the internet service provider, host name of the accessing computer
  • information about the website from which you are visiting us
  • referrer URL
  • used web browser (browser type and version) and operating system used
  • IP address assigned by your internet service provider 
  • files requested, amount of data transferred, downloads/file exports
  • information about the websites that you call up from us, including date and time
  • For reasons of technical security (in particular to defend against attempted attacks on our web server), this data is stored in accordance with Art. 6 para. 1, p.1 letter f DS-GVO. After 7 days at the latest, anonymization takes place by shortening the IP address so that no reference to the user is made.

In the context of a contact request, we collect and process the following data:

  •       name, first name
  • contact details
  • salutation
  • information about requests and interests

Automated decision-making

We do not employ purely automated processing procedures in making our decision.

Cookies (Art. 6 para. 1, p.1  letter f GDPR, § 25 para. 1, 2 TTDSG)

Our websites use so-called “cookies”. They serve the purpose of making our offering more user-friendly, effective and secure. Cookies are small text files that are placed on your computer and stored by your browser (locally on your hard drive). Cookies contain only pseudonymous, mostly even anonymous data.

Some cookies remain for the duration of a browser session (so-called session cookies), others are stored for a longer period of time (so-called persistent cookies). We do not use any third-party cookies on our website, nor do we use any services for tracking or marketing purposes.

Based on our legitimate interest (Art. 6 para.1, p.1 letter f DS-GVO), we use technically necessary cookies that are absolutely necessary for the operation of the website and to ensure its functionality. Furthermore, we use cookies without your consent insofar as their sole purpose is the storage of or access to information stored in the terminal device for the transmission of messages or they are absolutely necessary to provide the service you expressly requested, § 25 para. 2 TTDSG.

Assuming your consent, further cookies are used, by means of which we or third parties can, for example, evaluate how our services are used. This allows us to design the content according to user needs. In addition, the cookies enable us to measure the effectiveness of a particular advertisement and to have it placed, for example, depending on the  user´s topical interests. The legal basis for this is your express consent (Art. 6 para. 1, p.1 letter a DS-GVO, § 25 para. 1 TTDSG).

You can revoke your consent via our Consent banner at any time with effect for the future and change the cookie settings. Please note that changes must be made separately for each end device.

Most web browsers accept cookies automatically. Usually, however, you can also change your browser settings if you would rather not send us the information. In this case, you will still be able to use the offerings of our website without restrictions (exception: configurators).

Matomo (formerly Piwik)

On this website, we use the web analytics software Matomo Analytics (www.matomo.org), a service provided by InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand, ("Matomo").

We use Matomo to improve the user-friendliness of the website and for statistical purposes (statistical analysis of visitor access) on the basis of your consent pursuant to Art. 6 para 1, p.1 letter a DS-GVO, § 25 para. 1 TTDSG.

The information generated by the cookie about your use of this website (including your IP address) will remain on the servers of Yontex GmbH& Co. KG and will not be disclosed to third parties, unless required by law. The data is collected anonymously. A mapping of further information to your IP address does not take place in any case. Matomo allows us to analyze the flow of visitors to this website. It helps us to understand how visitors came to this website (for example, via the so-called referrer), which pages are accessed how often and for how long, or which browser was used to view them. This data helps us to improve the offer on this website. We can thus see which offers are most interesting, where navigation can be improved or whether technical requirements must be created so that this website can be displayed without errors.

IP addresses are automatically anonymized before the analysis data is stored. Matomo has also been configured so that only the anonymized IP address is used for data processing. Likewise, Matomo respects the "Do-not-track" setting of your browser.

The storage period of the data is 30 days.

If you do not agree with the storage and analysis of this data from your visit, you can object to the storage and use in the cookie settings at any time. In this case, a so-called opt-out cookie is stored in your browser, which means that we do not collect any session data.

Please note that the complete deletion of your cookies means that the opt-out cookie is also deleted and may have to be reactivated.

As long as you want to maintain the objection to the storage of the collected visitor data, you may not delete the aforementioned cookie, as otherwise the observance of your objection can no longer be technically guaranteed by us. YONTEX GmbH & Co. KG has an interest in cultivating customer relationships with you and providing information and offers about our own products and services. Therefore, we process your data to send you relevant information and offers by e-mail.

If you do not want this, you can object to the use of your personal data for direct advertising purposes at any time; the same applies to profiling to the extent that it is related to direct advertising. When you notify your objection, we will no longer process your data for this purpose.

Newsletter (Art. 6 para. 1, p.1 letter a GDPR)

You can also subscribe to a free newsletter on our website. The e-mail address indicated in the newsletter application and your name will be used for sending you the personalised newsletter.

In this respect, we observe the principle of data minimisation and data avoidance as only the e-mail address is marked as a mandatory field (and potentially your name, in the case of a personalised newsletter). As a matter of technical necessity and for legal protection, your IP address is also processed when you order the newsletter.

For sending newsletters by e-mail, we use the so-called double opt-in procedure. This means that you will only receive advertising by e-mail if you have previously expressly confirmed that you want us to activate the newsletter service. This is done by sending you a notification e-mail and asking you to confirm that you would like to receive our newsletter at this e-mail address by clicking on a link contained in this e-mail.

Naturally, you can always terminate the subscription by exercising the cancellation option provided in the newsletter, thereby revoking your consent. It is also possible to cancel your newsletter subscription directly on our website. 

Registration / customer account (Art. 6 para. 1, p.1 letter a, b DS-GVO)

On our website, we offer users the opportunity to register by providing personal data. The advantage is that you can in particular view histories and your specified data is stored for further operations. Thus, you do not have to enter them again when placing a new order.

Registration is therefore either necessary or possible for the fulfillment of a contract with you or for the implementation of pre-contractual measures.

The principle of data economy and data avoidance is observed here, as only the data required for registration is marked as a mandatory field with an asterisk (*).

For participation in the trade fair, we also require information about the company, the billing address (title, first name, last name, address).

By registering on our website, the user's IP address, the date and time of registration are also stored (technical background data). By pressing the "Send" button, you give your consent to the processing of your data.

Please note: The password you assign is stored by us in encrypted form. Employees of our company cannot read this password. They can therefore not give you any information if you have forgotten your password.

In this case, use the "Forgotten password" function, which automatically generates a new password which will be sent to you by e-mail. No employee is authorized to request your password from you by telephone or in writing. Therefore, please never mention your password if you receive such requests.

Once you have completed the registration process, your data is stored with us for use in the protected customer area. As soon as you log on to our website with your e-mail address as your user name and password, this data is made available for actions you perform on our website (e.g. for bookings). Executed bookings can be traced in the history. You can specify changes to the billing or delivery address here.

Social Media links

On our website you will find links to social media services of Meta/ Facebook, X , YouTube, and LinkedIn. Links to the websites of the social media services can be recognized by the particular company logo. If you follow these links, you will reach the company website of Yontex GmbH & Co. KG at this social media service. When you click on a link to a social media service, a connection is established to the servers of the social media service. This transmits to the servers of the social media service the fact that you have visited our website. In addition, further data is transmitted to the provider of the social media service. These are, for example:

  • address of the website on which the activated link is located
  • date and time when the website is called up or the link is activated
  • information about the browser and operating system used

Our website also contains - clearly recognizable - links to the websites of other companies. As far as links to websites of other providers are present, we have no influence on their contents. Therefore, no guarantee or liability can be assumed for these contents. The respective provider or operator of the pages is always responsible for the content of these pages. 

The linked pages were checked for possible legal violations and recognizable infringements at the time of linking. Illegal contents were not recognizable at the time of linking. However, a permanent control of the contents of the linked pages is not reasonable without concrete evidence of a violation of the law. If we become aware of any infringements, such links will be removed immediately.
